1. Introduction

Welcome to MyVOC (“we”, “us”, “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website, digital VOC platform, mobile wallet cards, and related services (“Services”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use our Services.

These Terms apply to all users, including workers, businesses, training providers, and visitors.

2. Eligibility

To use our Services, you must:

  • Be at least 18 years old or have legal capacity;
  • Provide accurate, current, and complete information;
  • Comply with all applicable Australian laws and workplace regulations.

Businesses must ensure that individuals acting on their behalf are authorised to do so.

3. Our Services

MyVOC provides a digital platform that allows:

  • Workers to create a free digital competency card;
  • Businesses to register, create competency lists, and issue VOCs;
  • Workers to store VOCs issued by multiple companies;
  • Secure storage, verification, and sharing of competency records.

We do not provide training, competency testing, or qualification assessment. All VOCs issued through the platform are the responsibility of the issuing business or provider.

4. User Accounts

4.1 Workers

Workers may create a personal account and receive a digital VOC card stored on their device. You are responsible for maintaining the confidentiality of your login credentials.

4.2 Businesses

By creating a business account, you warrant that you are authorised to bind your organisation to these Terms. Businesses are responsible for the accuracy, integrity, and validity of all VOCs they issue.

4.3 Account Security

You must notify us immediately of any unauthorised access or suspected breach. We are not liable for any loss arising from your failure to secure your account.

5. Issuing of VOCs

  • VOCs may only be issued by a business or provider that has verified the worker’s competency.
  • MyVOC is not responsible for verifying or validating the accuracy of any competency assessments.
  • Workers accept that all competency decisions are made solely by the issuing business.

MyVOC may remove or disable a VOC if it is fraudulent, incorrect, or violates these Terms.

6. Fees and Payments

Workers may use the platform free of charge.

Businesses may be charged subscription fees as outlined in the Pricing section of the website.

All fees are displayed in AUD and may include GST where applicable. We reserve the right to update pricing with notice.

7. Acceptable Use

You agree not to:

  • Misuse or attempt to exploit the platform;
  • Issue fraudulent, inaccurate, or misleading VOCs;
  • Attempt to access accounts without permission;
  • Use the platform for unlawful or unsafe workplace practices;
  • Copy, reproduce, or distribute platform content without permission.

We may suspend or terminate access for violations.

8. Data Privacy and Security

We handle personal information in accordance with the Australian Privacy Act 1988 and our Privacy Policy.

By using our Services, you consent to the collection and handling of data as described in the Privacy Policy.

We use secure encryption and wallet technologies, but cannot guarantee absolute internet security.

9. Intellectual Property

All website content, branding, software, and digital card designs are owned by MyVOC or licensed to us. Users may not copy, resell, or modify the platform or materials without written consent.

10. Third-Party Integrations

Our Services may integrate with third-party platforms (e.g., mobile wallets, training providers, identity verification tools). We are not responsible for the performance or actions of these services.

11. Service Availability

We aim to provide continuous, uninterrupted access, but we do not guarantee uptime.

We may suspend access for maintenance, upgrades, or unforeseen technical issues.

We are not liable for loss of productivity, revenue, or data resulting from downtime.

12. Disclaimer of Liability

To the fullest extent permitted by Australian law:

  • Our Services are provided “as is”.
  • We do not guarantee the accuracy of VOCs issued by businesses.
  • We are not responsible for workplace safety decisions, compliance obligations, or hiring decisions made using our platform.
  • We are not liable for indirect, incidental, or consequential damages.

Nothing in these Terms excludes guarantees under the Australian Consumer Law (ACL).

13. Indemnity

You agree to indemnify and hold harmless MyVOC, its directors, staff, and partners from any claims, damages, or losses arising from:

  • Your misuse of the platform;
  • Incorrect or fraudulent VOCs issued by your business;
  • Any breach of these Terms.

14. Termination

We may suspend or terminate accounts that:

  • Breach these Terms;
  • Abuse the system;
  • Issue fraudulent competency records;
  • Pose a security or compliance risk.

Users may delete their account at any time.

15. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted on the website. Continued use constitutes acceptance of updated Terms.

16. Governing Law

These Terms are governed by the laws of Australia and the State/Territory of Queensland. Any disputes will be handled in Australian courts.
